Welcome to My Lasts. These Terms of Service ("Terms") govern your access to and use of the My Lasts platform, including the website at mylasts.com, the application at mylasts.com, and all related services (collectively, the "Service"), operated by LegacyVault Technologies LLC ("Company", "we", "us", or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use My Lasts. By registering, you represent that you are of legal age and have the capacity to enter into a binding agreement. Accounts created by anyone under 18 will be terminated upon discovery.
2. Account Registration
To use the Service, you must create an account by providing accurate and complete information, including your name, email address, phone number, and country of residence. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify us immediately at support@mylasts.com if you suspect unauthorized access to your account.
3. Description of the Service
My Lasts is a digital legacy platform that allows you to securely store messages, videos, audio recordings, documents, and other digital content ("Legacy Content") intended to be delivered to designated recipients ("Grantees") upon activation of your digital legacy.
The Service includes the following core features:
- Legacy Content Storage: Encrypted storage of files, letters, videos, and audio intended for your Grantees.
- Grantee Designation: The ability to assign specific recipients for your Legacy Content with delivery conditions.
- Heartbeat Verification: A periodic life verification system that sends SMS and/or email notifications requesting you to confirm your active status. This mechanism is central to determining when your digital legacy should be activated.
- Legacy Activation: Delivery of your Legacy Content to designated Grantees based on conditions you configure, such as missed heartbeat verifications or a predetermined date.
4. Heartbeat Verification System
The heartbeat verification feature is a core component of the Service. It works as follows:
- The system periodically sends you a notification (via SMS and/or email) requesting you to verify that you are alive and active.
- You verify your status by clicking a secure link provided in the notification.
- If you fail to respond within the configured timeframe and after the allowed number of attempts, the system may proceed to activate your digital legacy according to your instructions.
You acknowledge that the heartbeat verification system relies on your timely responses. Failure to respond to verification requests may result in the activation and delivery of your Legacy Content to your Grantees. It is your responsibility to keep your contact information up to date and to respond to heartbeat verification requests promptly.
5. SMS Communications
5.1 Consent
By creating an account on My Lasts and checking the SMS consent checkbox during registration, you expressly consent to receive transactional SMS messages from My Lasts to the phone number you provide.
5.2 Types of Messages
SMS messages from My Lasts are strictly transactional and related to the heartbeat verification feature. You may receive the following types of messages:
- Verification requests: Asking you to confirm you are active by clicking a secure link.
- Verification confirmations: Confirming that your heartbeat verification was successful.
- Verification alerts: Notifying you when a verification is pending, has expired, or requires attention.
5.3 Message Frequency
You will receive up to 4 SMS messages per month. Message frequency depends on your heartbeat verification schedule and your responses.
5.4 Rates and Charges
Message and data rates may apply depending on your mobile carrier and plan. My Lasts does not charge for SMS messages, but your carrier may apply standard messaging fees.
5.5 Opt-Out
You may opt out of receiving SMS messages at any time by replying STOP to any message from My Lasts. After opting out, you will receive a single confirmation message. Please note that opting out of SMS will affect the heartbeat verification functionality, which is a core part of the Service. You are responsible for ensuring alternative verification methods are configured if you opt out of SMS.
5.6 Help
For assistance with SMS messages, reply HELP to any message from My Lasts, or contact us at support@mylasts.com.
5.7 Supported Carriers
SMS messages are supported on major U.S. carriers, including but not limited to AT&T, Verizon, T-Mobile, and their MVNOs. Carrier support is not guaranteed, and delivery may vary.
5.8 No Marketing
My Lasts does not send marketing, promotional, or advertising messages via SMS. All SMS communications are transactional and directly related to the operation of the Service.
6. Legacy Content and Your Responsibilities
You retain ownership of all Legacy Content you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to store, process, and deliver that content solely for the purpose of providing the Service as described in these Terms.
You are solely responsible for the content you upload. You agree not to upload content that is illegal, infringes on third-party rights, contains malware, or violates any applicable law. We reserve the right to remove content that violates these Terms.
7. Grantee Access
Your Grantees will only receive access to the Legacy Content you have specifically designated for them, and only when the activation conditions you have configured are met. We are not responsible for verifying the identity of Grantees beyond the information you provide.
8. Data Security and Encryption
We take the security of your data seriously. All Legacy Content is encrypted both in transit and at rest using industry-standard encryption protocols. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

9. Subscription and Payments
Certain features of the Service may require a paid subscription. Pricing, billing cycles, and payment terms will be clearly presented at the time of purchase. All fees are non-refundable unless otherwise stated or required by applicable law.
We reserve the right to modify pricing with reasonable advance notice. Continued use of paid features after a price change constitutes acceptance of the new pricing.
10. Account Termination
10.1 By You
You may delete your account at any time through your account settings or by contacting support@mylasts.com. Upon deletion, your Legacy Content will be permanently removed, and any pending legacy activations will be cancelled.
10.2 By Us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will make reasonable efforts to notify you before termination, except where prohibited by law or where immediate action is necessary to protect the Service or other users.
11. Intellectual Property
The My Lasts platform, including its design, code, logos, trademarks, and documentation, is the property of LegacyVault Technologies LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. We do not guarantee that SMS messages or emails will be delivered successfully to you or your Grantees, as delivery depends on third-party carriers and service providers.
13. Limitation of Liability
To the maximum extent permitted by applicable law, LegacyVault Technologies LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from the activation or non-activation of your digital legacy.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless LegacyVault Technologies LLC and its affiliates from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
15. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will notify you of material changes through the Service or via email. Continued use after changes take effect constitutes acceptance of those changes.
16. Modifications to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and notify you through the Service or via email for material changes. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.
17. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, held in the State of Florida.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and LegacyVault Technologies LLC regarding your use of the Service.
